There are no statutory provisions or published cases dealing with surrogacy under Mississippi laws.  It is thus unclear how Mississippi law would treat a surrogacy agreement.  Surrogacy agreements that include lesbian, gay, bisexual or transgender individuals are also unclear.  However, Mississippi’s adoption law obviously discriminates lesbian, gay, bisexual or transgender individuals.  It states that “couples of the same gender” may not petition to adopt a child.
