Nevada Surrogacy Law

Nevada Revised Statute Ann. § 126.045, allows married couples to enter into a contract with a surrogate for “assisted conception.”  It states that such contracts must contain provisions which specify the respective rights of each party, including the parentage of the child; custody of the child in the event of a change of circumstances; and the respective responsibilities and liabilities of the contracting parties.  A person identified as an intended parent in a surrogacy contract in Nevada is treated in law as a natural parent.  The statute further states that it is unlawful to pay or offer to pay money or anything of value to the surrogate except for the medical and necessary living expenses related to the birth of the child as specified in the contract.

Nev. Rev. Stat. Ann. § 126.045 also defines “assisted conception”, “intended parents” and “surrogate” to add more clarity to the subject.    “Assisted conception” refers to a pregnancy resulting when an egg and sperm from the intended parents are placed in a surrogate through medical interference.  “Intended parents” is defined as a man and woman, married to each other, who enter into an agreement stating that they will be the parents of a child born to a surrogate through assisted conception.  A “Surrogate” as used in this section is an adult woman who enters into an agreement to bear a child conceived through assisted conception for the intended parents.
